These Terms of Service (“Terms”) govern the use of the services and website provided by FrienTrip (“we”, “our”, “FTJ” or “the Service”). By accessing or using the Service, users (“you” or “the User”) agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Scope of Service

FrienTrip introduces guides who provide travel-related experiences, arrangements, and related services. Service content, availability, and pricing may vary and may be modified at any time without prior notice.

FrienTrip operates as a matching and introduction platform and is not a travel agency or tour operator.

FrienTrip does not itself provide transportation, accommodation, or travel services, and is not a party to any agreement entered into directly between Users and guides (“Friends”).

2. Eligibility

Users must be legally capable of entering into binding contracts under applicable law. The Service is not intended for minors without appropriate consent.

3. User Responsibilities

Users agree to:

  • Provide accurate and complete information during inquiries, reservations, or communications
  • Comply with applicable laws, regulations, and travel rules
  • Not engage in any activity that interferes with the operation of the Service
  • Not misuse the Service for fraudulent, harmful, unlawful, or abusive purposes

We reserve the right to refuse service to any User who violates these Terms or behaves in a manner deemed unsafe or inappropriate.

4. User Relationship with Guides

Guides (“Friends”) introduced through the Service act independently and are not employees, agents, or representatives of FrienTrip.

Any agreements, conduct, or interactions between Users and Friends are the responsibility of the respective parties, subject to the rules of the Service.

5. Fee

The fee for the tour is calculated as follows;

FTJ collects 20% of the amount agreed upon between Friend and Guest as a system usage fee.

6. Reservations and Payments

Reservations and payments may be processed through third-party payment providers such as Stripe. Credit card information and related financial data are handled in accordance with such providers’ terms and privacy policies.

Reservations are not confirmed until payment is successfully processed.

Prices are displayed in the specified currency and may include taxes or additional charges where applicable.

7. Cancellation and Refund Policy

Unless otherwise stated:

  • Cancellations requested by Users may be subject to cancellation fees
  • Refund eligibility depends on the timing and nature of the cancellation
  • Non-refundable components (such as admission tickets, transport arrangements, or third-party bookings) may apply
  • No refunds will be issued for late arrival, no-shows, or User circumstances beyond our control (including illness, travel delays, or document issues)

Refund rates based on cancellation notification timing are as follows:

  • On the tour date: 0%
  • 2 weeks prior to the day before: 20%
  • More than 2 weeks prior: 100%

If the Service must cancel due to FTJ’s operational reasons, Users will receive a full or partial refund depending on the circumstances.

Refunds will be processed through the original payment method where possible.

8. Changes to Itinerary or Service

For safety, operational, or regulatory reasons, parts of the Service may be altered, rescheduled, or replaced. Such changes may include adjustments due to weather, venue availability, transportation conditions, or official advisories.

We are not liable for losses arising from schedule changes caused by events reasonably outside our control.

Users are solely responsible for confirming that their participation complies with local laws, visa conditions, health requirements, and personal safety considerations.

9. Assumption of Risk

Participation in travel-related experiences may involve inherent risks, including but not limited to transportation, weather conditions, cultural practices, personal mobility limitations, and external environmental conditions. Users participate voluntarily and assume such risks.

10. Disclaimer of Warranties

To the fullest extent permitted by applicable law:

  • The Service is provided “as is” and “as available”
  • We make no warranties regarding accuracy, reliability, availability, or suitability for particular purposes
  • We do not guarantee uninterrupted or error-free access to the Service

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  1. Indirect, incidental, punitive, or consequential damages
  2. Loss of profits, revenue, travel expenses, or opportunity costs
  3. Damages arising from User decisions, transportation delays, cancellations, force majeure, or third-party actions
  4. Injuries, accidents, theft, or losses occurring during off-site experiences

The refunds, if any, shall not exceed the total amount paid by the User for the relevant Service.

Some jurisdictions do not allow certain limitations; in such cases, only permitted limitations apply.

12. Prohibited Conduct

Users must not:

  • Engage in fraud, harassment, or abusive behavior
  • Impersonate other individuals or provide false information
  • Interfere with Service operations or data systems
  • Exploit the Service for commercial gain without written permission

Violation may result in service denial and legal action.

13. Intellectual Property

All content, materials, trademarks, and branding displayed on the website or within the Service remain the property of the operator or licensors. Users may not reproduce, distribute, or modify such content without written authorization.

14. Data Protection and Privacy

Personal information is collected and processed in accordance with our Privacy Policy, which forms part of these Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted under the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Japan unless otherwise required by applicable consumer protection laws.

16. Modifications to the Terms

We may revise these Terms at any time. Updated versions will be posted on the website and become effective upon posting unless otherwise required by law.
